Wednesday is the deadline for the prosecution in the Anthony Bertolone case to write a response to the defense’s closing arguments.

Bertolone is accused of assaulting his fraternity brother in his sleep and recording the sex acts.

Bertolone claims the two men were in a romantic relationship and that what is seen in the recordings was consensual.

Bertolone opted for a bench trial which means only the judge rules on the case.

The trial was held last month and the defense had until April 6th to write its closing arguments then the state had five days to respond.

The judge now has 60 days to make a ruling.

If convicted, Bertolone faces up to 50 years in prison.
