PELLA POOL: Family Suing City Over Deaths
In the next couple of weeks, we should find out if a lawsuit against the City of Pella will go to trial.
The suit also names a group that runs a Christian summer camp as a defendant.
It stems from the drowning deaths of two boys at the Pella swimming pool in July 2010. The underwater lights weren’t on at the time of the boys’ deaths and hadn’t worked for years because of faulting wiring.
The families of the two boys are suing Pella and the “Fellowship of Christian Athletes”, claiming they both neglected the boys’ safety.
The City of Pella wants to avoid a trial in the matter.
In March, the city requested a summary judgment, wherein a judge would consider the facts of the case then issue a ruling.
This week, attorneys for the boys’ families were told they have just two weeks left to formally make their case against the City of Pella’s request.
A judge will then consider both sides’ arguments before deciding if he’ll allow a summary judgment hearing.
