The Federal Judge presiding over the $1 billion defamation lawsuit between BPI and ABC news has resigned from the case.

Beef Products Incorporated makes a product known as lean finely textured beef. In February, ABC aired a report in which a USDA scientist labeled the product, “pink slime.”

After the report aired, some stores stopped carrying BPI products. The major loss in sales forced BPI to shut down a plant in Waterloo.

The company says the news network is responsible because they mislead consumers into believing their product was unhealthy and unsafe.
