AGRIBUSINESS: Agricultural Land Owners Liable

The Iowa Supreme Court dealt a blow to the Iowa Recreational Use Statute. In a decision Friday morning the court determined that owners of agricultural land opened for public use are not held liable for injuries only if persons on the property are unsupervised and participating in a recreational sport.

In a separate case, the Iowa Supreme Court found that waivers signed by parents on behalf of their children were unenforceable, which leaves agricultural land owners without any real protection should they invite anyone to their property except having adults sign liability release forms.

The judge presiding over the case was nominated by current USDA secretary, Tom Vilsack during his tenure as Governor.
