GUN ARREST: Man Refuses To Show Permit To Carry

A  Des Moines man was arrested at a metro Walmart Tuesday after refusing to show his permit to carry a weapon to a police officer.

An off-duty Des Moines police officer was working at the Walmart at 5101 SE 14th Street in Des Moines Tuesday a little before 6:30 p.m. when he noticed a man in the store with a black handgun holstered to his belt. The officer, in full police uniform, approached the man and asked him if he had a license to carry the weapon.

The man, later identified as 23-year-old Dennis Estell, told the officer he did have a permit. The officer asked him to produce it and Estell told the officer, “No, it’s my right to carry this and I don’t have to show you my permit.” The officer asked again to see the permit and Estell refused.

The officer took Estell into custody and seized the gun, which had a round in the chamber and a loaded magazine.

Estell is charged with carrying weapons and interference with official acts.

The police report shows Estell does have a permit to carry, issued out of Madison County.

According to Iowa Code 724.5, “A person armed with a revolver, pistol, or pocket billy concealed upon the person shall have in the person’s immediate possession the permit provided for in section 724.4, subsection 4, paragraph “i”, and shall produce the permit for inspection at the request of a peace officer.  Failure to so produce a permit is a simple misdemeanor.”
