A Polk County judge has decided not to dismiss manslaughter charges against a Des Moines doctor.
Daniel Baldi is charged with ten counts of manslaughter in connection with the deaths of ten former patients.
The prosecution claims Baldi recklessly prescribed pain killers to those patients, who later died of drug overdoses.
Baldi’s attorney argued in four of the deaths, Baldi didn’t prescribe the drugs that killed patients and in others, the medications found during autopsy were within therapeutic levels.
In the ruling the judge says whether a crime was actually committed in this case is for the jury to decide.
Baldi’s trial is currently set for December 2nd.
