The Iowa Supreme Court has denied a motion filed Wednesday by the Iowa Attorney General’s Office to immediately stay a district court’s ruling that former Iowa State University basketball player Bubu Palo be allowed back on the team.

Palo was kicked off the team in 2012 after he was charged with sexual abuse. Those charges were dropped and Palo was allowed to re-join the Cyclones last season.

After the season, he was removed from the team again by President Steven Leath. Palo was allowed to remain a student in good standing at the university and keep his athletic scholarship.

Last week a district judge questioned the university’s grounds for its decision and ruled Palo should immediately be re-instated pending the outcome of his lawsuit against Iowa State and the Iowa Board of Regents.
