The Iowa Supreme Court will not hear the case of a former Drake University student convicted of sexually assaulting his fraternity brother.

Anthony Bertolone was found guilty of five counts of sexual assault in May of 2012. The assaults took place while the victim was unconscious or sleeping and Bertolone recorded many of the incidents. The recordings were discovered by the victim on Bertolone’s laptop.

Bertolone appealed the conviction but in November the Iowa Court of Appeals upheld the decision.

Wednesday the Iowa Supreme Court declined to review his case.

Bertolone is serving a 20 year prison sentence.
