CLIVE, Iowa -- Attorneys for the Missouri Highway Patrol were slapped with sanctions Tuesday for failing to turn over information regarding the drowning death of a Clive man at the Lake of the Ozarks last year.
Brandon Ellingson drowned while hand-cuffed and in police custody. His family has filed a lawsuit against the arresting officer and the state of Missouri, claiming Ellingson's civil rights were violated.
Tuesday a Missouri judge sanctioned attorneys representing the Missouri State Patrol for not producing a log of emails, that the state claims should remain confidential, because they contain communication between attorneys and their clients.
The judge fined the Missouri Attorney General's Office $9,500 and ordered the state's attorneys to produce the log by November 17, 2015.
