Ruling Barring Woman from Becoming Pregnant Overturned

DES MOINES, Iowa — A Floyd County judge is under fire for banning a woman from getting pregnant.

Twenty-four-year-old Stephanie Fatland was charged with child endangerment last year. In court, she opted for a plea deal from Judge James Drew.

fatland_stephanieThe plea deal included a suspended sentence, five years of probation, and a condition saying Fatland was banned from getting pregnant.

Judge Drew justified the condition saying it was “directly related to Fatland’s criminal conduct and rehabilitative needs.”

The Iowa Court of Appeals disagreed. In a ruling released Wednesday the court said the ban “impinges on her privacy right of procreation.” The ruling also said it didn’t serve a rehabilitative purpose.
