Police: Murder Suspect Caught in Kansas, Will be Charged After Extradition

WICHITA, Kansas -- A man wanted on a material witness warrant in the killing of a Des Moines man has been arrested in Kansas and officials say he will be charged with murder in the case.

28-year-old Steven Asbury was arrested Tuesday in Wichita, Kansas. Des Moines police had originally sought him as a witness in the murder of 41-year-old James Patton on July 21.

Patton was found in the area of East 14th Street and East Ovid Avenue, suffering from several gunshot wounds in the chest and groin. He died shortly after being transported to a local hospital.

Asbury was identified as a possible witness in the case at the end of July and police asked for the public to help find him.

Police say extradition proceedings for Asbury will begin immediately and once he is returned to Iowa the Polk County Attorney’s Office will charge him with first-degree murder.
