SEXUAL ASSAULT: Bertolone Trial Begins

Testimony began Monday morning in the trial of a former Drake student accused of sexually assaulting one of his fraternity brothers.

Twenty-two-year-old Anthony Bertolone is facing five counts of third degree sexual assault.  Authorities say the abuse took place from January to June of 2010.

Monday morning, the father of the accuser took the stand.  He says his son called him and was upset after seeing some pictures that appeared to show him being sexually assaulted by Bertolone.

Bertolone’s defense says the two fraternity brothers were inseparable and had a “relationship”.  They smoked marijuana and got drunk together and often times slept in the same bed.

Polk County Judge Scott Rosenberg is hearing the case instead of a jury.
