People living in two Des Moines apartment buildings can now move forward with a class-action lawsuit over a bedbug problem.

The Iowa Supreme Court said Friday that it deadlocked with three justices siding with a district court judge’s 2011 ruling certifying class-action status and three who would reverse it. One did not participate. That means the Polk County judge’s certification of class-action stands.

The buildings’ owners and managers wanted the court to throw out class-action certification.

In 2010, residents of Elsie Mason Manor and Ligutti Tower sued the building owners and managers.

The lawsuit claims managers knew about bedbugs but didn’t warn tenants or properly treat for them until the lawsuit was filed.
