DES MOINES, Iowa — An Iowa State University student was arrested Tuesday night after police say he tried to break into a school and a van.
Twenty-one-year old Joseph Foss of Harlan is charged with 3rd degree attempted burglary and public intoxication.
According to a police report, Des Moines officers were called to 42nd and Grand Avenue on a possible accident around 10:45 Tuesday night. When they arrived they found a vehicle that appeared to have hit the curb. The passenger side tires of the vehicle were flat.
Officers were approached by a woman who said she was cleaning St. Augustin School when a man tried to get inside. She told officers he was lying in the grass by the school.
Officers searched the area and found Foss in the driveway of 402 44th Street. He was trying to open the door of a minivan. When he saw the police officer, Foss put his hands in the air and laid down on the ground. He was arrested without incident.
A breathalyzer tested at .161 blood alcohol contact.
Foss was booked into the Polk County Jail.
