Ellingson Family’s Case Against Missouri State Patrol Advancing

A lawsuit against the Missouri State Patrol is moving forward.

The family of Brandon Ellingson is suing the Patrol and Trooper Anthony Piercy over Ellingson’s drowning death in 2014.

Ellingson was in custody and handcuffed when he fell out of a law enforcement boat and drowned in the Lake of the Ozarks.

This week, a judge allowed most of the family’s lawsuit alleging negligence and civil right violations to go forward. In the ruling, Jennifer Ellingson, Brandon’s sister, was removed as a plaintiff in the case.

Several defendants named by the Ellingson family were also dismissed from the suit. Just one of the nine counts in the lawsuit was fully dismissed, conspiracy to commit abuse of process.
